Court Issues Restraining Order Against MP Charged With Rape

MENTI Central MP Gideon Mwiti has been cautioned against contacting a woman he is accused of raping.

If he contacts her, he will be remanded, said chief magistrate Lucy Mbugua yesterday. Mbugua also warned Mwiti’s family, friends and agencies against contacting the woman until the rape case is concluded, or Mwiti’s bail will be cancelled.

However Mbugua upheld the decision granting bail to GMwiti, saying the prosecution did not give sufficient evidence to prove witness tampering.

Prosecutors had on Wednesday asked the court to cancel the application on grounds that Mwiti was interfering with witnesses in the case.

Last week, Mwiti was released on a Sh100,000 cash bail after his lawyers said he was suffering from diabetes and was not strong enough for police custody.

The MP was charged with rape, intimidation and indecent assault. His case will be heard in April 21.
